1. About FormaBit

FormaBit is a service provided by S2P2 Creations. These Terms and Conditions ("Terms") govern your access to and use of the FormaBit platform, including our website, applications, and all related services (collectively, the "Service"). By accessing or using FormaBit, you agree to be bound by these Terms.

2. Acceptance of Terms

By creating an account or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Description of Service

FormaBit is an AI-powered platform that enables users to create professional LinkedIn carousels. Our Service includes:

• A visual carousel editor with customizable slides and themes
• AI-powered content generation to help you create compelling carousel content
• PDF export functionality for downloading your carousels
• Direct LinkedIn posting integration to publish carousels to your LinkedIn profile
• A credit-based system for accessing premium features
• Various slide types including hook slides, content slides, quote slides, stat slides, and call-to-action slides

4. User Accounts

4.1 Account Creation

To access certain features of the Service, you must create an account. You may sign up using your email address or through third-party authentication providers (e.g., Google). You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4.2 Account Responsibilities

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this section.

5. Credits and Payment Terms

5.1 Credit System

FormaBit operates on a credit-based system for premium features. The following terms apply:

• Each carousel export (PDF download) costs 1 credit
• AI-powered content generation is free and does not consume credits
• Credits do not expire once purchased
• New users receive complimentary credits upon registration
• Additional credits can be purchased through our platform
• Credits are non-transferable between accounts

5.2 Payment Processing

All payments are processed securely through our authorized payment provider. By making a purchase, you agree to pay the applicable fees and authorize us to charge your selected payment method. All prices are displayed in the applicable currency and include any applicable taxes. Refunds are subject to our refund policy.

6. Acceptable Use Policy

6.1 Permitted Uses

You may use our Service to:

• Create and design LinkedIn carousels for professional and personal use
• Generate AI-powered content for your carousels
• Export and download your carousels as PDF documents
• Post carousels directly to your LinkedIn profile
• Share your created content on social media and other platforms

6.2 Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Create content that is defamatory, obscene, abusive, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Use automated means (bots, scrapers, etc.) to access the Service without our prior written consent
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Use the Service to distribute spam, malware, or other harmful content
• Resell or redistribute the Service without our authorization

7. Data and Content

7.1 Your Data

You retain ownership of all content you create using our Service. By using the Service, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you. We will not use your content for any other purpose without your explicit consent.

7.2 Data Security

However, no method of transmission over the Internet is completely secure, and we cannot guarantee the absolute security of your information. You are responsible for maintaining the confidentiality of any sensitive information you input into the Service.

8. Service Availability

8.1 Uptime

We strive to maintain high availability of our Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime in advance.

8.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service. 9. Intellectual Property

The Service, including its original content (excluding user-generated content), features, and functionality, is and will remain the exclusive property of S2P2 Creations. 10. Termination

10.1 By You

You may terminate your account at any time by contacting us at hello@formabit.in. Upon termination, your right to use the Service will immediately cease. Any unused credits at the time of account termination will be forfeited.

10.2 By Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease. We may also delete your account data in accordance with our data retention policies.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall S2P2 Creations, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

12. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. S2P2 Creations does not warrant that the Service will function uninterrupted, secure, or available at any particular time or location.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
